Racing Industry Bill passes third reading (25 June 2020)
The Racing Industry Bill passed its third reading on 25 June 2020. The Bill, which is the final legislative response to the Messara report, finalises the post transition structure of the racing industry.
Passage of the Bill had been delayed due to COVID-19 which resulted in the racing industry transition period being extended by Order in Council to 30 June 2021.
Several amendments were made to the Bill during the Select Committee stage. These amendments included:
- the inclusion of Racing New Zealand as an entity within the Bill rather than being allowed for through regulations. Racing New Zealand is a collaborative body for the codes and other industry organisations enabling collective decision making. Racing New Zealand can also perform powers delegated to it by the codes;
- strengthening considerations of community interests in racing property when a decision is being made on the vesting of property in codes; and
- the scaling back of many Ministerial powers and the enabling of agreements through commercial arrangements.
A Supplementary Order Paper was introduced by the Minister for Racing and agreed to at the Committee of the Whole House stage. The SOP:
- revokes the Order in Council extending the transition period from 1 August when the Bill will come into force;
- named the Racing Industry Transition Agency (RITA) Board as the inaugural TAB NZ Board until such a time as substantial appointments can be made; and
- made a variety of minor technical changes to the Bill.
In his third reading speech, the Minister for Racing thanked the Select Committee and 900+ submitters for their contributions to strengthening the Bill. The Minister took the time to acknowledge the various groups that had contributed to getting the Bill to this stage and emphasised the importance of the industry now taking the reins as it looks to rebuild itself following decades of decline.
Racing Industry Bill introduced (5 December 2019)
The Minister for Racing introduced the Racing Industry Bill which forms the Government’s final legislative response to the recommendations of the Messara Report. Subject to its passage, the Racing Industry Bill will implement changes to the racing integrity system that are based on a report by Mr Malcom Burgess MNZM. This report can be found here:
In December 2018 the Minister for Racing commissioned a Ministerial Advisory Committee (the MAC) to inform the next steps on the Messara Review. Members of the MAC have since been appointed to the Racing Industry Transition Agency to lead a program of change for the New Zealand racing industry. Repeal of the betting levy announced (17 May 2019)
The Minister for Racing announced the repeal of the totalisator duty (betting levy). The levy will be phased out and these funds will instead be reinvested with the racing and sports sectors. A proportion of these funds will also be set aside for industry led gambling harm minimisation initiatives. You can read the announcements here:

Government announces reform to NZ Racing Industry (17 April 2019)
The Minister for Racing announced changes to revitalise the New Zealand racing industry. Cabinet has agreed to the overall intent of the Review of the New Zealand Racing Industry (the Messara Report) and have agreed to plans to implement reforms through two Bills to amend the Racing Act 2003. The first Bill, due to be enacted by 1 July 2019, will begin the process of structural reform and provide financial relief to the industry.

Review of the New Zealand racing industry released (30 August 2018)
In April 2018 the Minister for Racing, Rt Hon Winston Peters appointed senior Australian racing expert John Messara to review the New Zealand racing industry’s governance structures, and provide recommendations on future directions for the industry.
